The regulation was challenged in the WTO, and after protracted litigation an arbitration panel ruled in June 2001 in favor of the US shrimp import ban, noting in part US good faith efforts to negotiate a turtle protection treaty. This is an important victory for environmentalists and removes a major source of complaint against the WTO; it constitutes a precedent that can be used in other environmental cases."
